The lawsuit with IBM...
This is just my opinion. I work for the largest company in the world. Keep in mind that I am not in their legal department, but I have a few friends that are.

As a best practice the company I work for avoids going to cort in lawsuits pretty much at all cost. The reasons are that they consider us to have deep pockets and the jury looks at us like a cash cow.

The company I work for will usually keep the negotations going until just before the cort date and then reach a settlement.

In my opinion I will venture to say that IBM will do the same with QSGI, Inc. The jury will look at IBM as a cash cow and have sympathy for QSGI.

I am not an expert, but I would almost bet the bank that IBM will do the same.

Keep in mind that I have not had time to research what the lawsuit is about..
