Sure -- I have no problem at all with that. Like for all of us who have lived their entire lives without depending on a union to think for them and act as a surrogate nanny for them, the worker agrees with the employer to the terms of his employment at the time he is hired. Either side may terminate the relationship at any time without recourse, and from time to time that agreement between them can be renegotiated.
If the worker feels the need, he may even join a union, but it is a decision that is voluntary, not mandated.
There are many states where this is the common and accepted way of employment. Try it sometime -- you may even like being independent.
