>>Questions/Observations for discussion...any input from the true longs would be greatly appreciated:
>>Do we know for certainty the case has been rescheduled?
No, but we also know that several board members who contacted the court were assured that it will be rescheduled under Texas' Byzantine system. Unknown if it will be rescheduled soon or after another three month wait.
>>How or when will we know?
The court will post a new schedule showing when a particular case is set to begin. Several board members are on this and will pass the info.
>>Will we know a specific date at that point too?
Yes, once rescheduled. Several on this board have referenced the court's web site.
>>What is a typical delay timeframe?
Nothing really typical. Here in MA district court cases are scheduled 3-8 months ahead. However, there is a 1 in 3 chance that that date will slip. It involves having a court room and judge available; lawyer and witness availability; no other case running over and taking our case's court availability; etc.
>>Will or could this delay affect negotiations with T-Mobile?
Probably has but that's an unknown to anyone outside of the board and the court. That the TM stay is now five months old suggests that there has been some agreement between CLYW and TM but it remains secret and perhaps contingent upon other factors we know not.
>>in your opinion, would this delay make Drago more eager to settle?
Good question. A look through Google suggests that his real career is using the courts to bleed out companies he targets. That former board members signed insane agreements and prior settlements re. CLYW suggests he will go the limit before he agrees to settle or until the case is concluded. OTOH, he seems about at the end of his ability to cheat his way out of this case.
