It seems you don't have access to the information. Read the December 10-Q and 8-K. Includes the bits about the DEC participating in the stack tests and their giving JBI permission to begin commercial operations. The first time in New York history thing, was part of the December 2010 conference call. If you feel it is a lie I suggest you report it to the NY DEC. Let me know how far you get with that.
