Correct. A finding of guilt in a civil trial is "the preponderence of evidence" rather than a criminal trial's higher standard of "beyond a reasonable doubt." In MA, a conviction is based upon all but two of the jurors finding guilt through the preponderence of evidence. I don't know about TX. Also in MA is the option of the defense to go for "shared guilt." Let's say the jury finds Daic 75% guily. That means (.75) X money awarded by the jury.
