true, but check this: This form must be filed with the SEC 10 days before definitive information statements are distributed to shareholders and helps the SEC protect shareholders' rights by ensuring that they receive key information, clearly presented.

So they probably have to file a new 14C and change the date...since they never filed the definitive 14c 10 days after...
