I emailed him as well a couple months ago. He said he had not talked to Kuni in 6 months at that time.

He was/is just a consultant for them. This company has no American staff beyond Kuni. If you look at the Q3 finanicals, the San Diego office only lists a staff of two (both are outsourced, Toby and Chuck). Kuni is of course in LA.

And to respond to why he is listed as the CSO; none of staff listed actually work for the company (besides Kuni and Naoto). Mark is outsourced hire and so is the legal staff. They are listed because the company doesn't need or can't afford those positions within the company at this time.
