The other players in any conspiracy with a company acting as a conduit between shady businesses and the market, are the shady businesses themselves.

It is quite obvious that Gene knew exactly what was happening to the shares he was selling to Gendarme. So whether he was a part of the actual conspiracy or just knowingly taking advantage of the crime won't matter much if it ever gets to RICO.
