Transat5, the biggest "dilemma" in this naked shorting is where the DTC utilizes "electronic shares", which are invisible to normal record keeping methods. They exist only in cyberspace so to speak. However, they do in fact dilute the heck out of the targeted stock. Lawsuits have been initiated against an individual MM like Knight Trading Group, and included the DTC because of their involvement. The playing field is seriously weighted in their favor.
