IN 2003, IF CMKX WAS APPROVED OR ACCEPTED BY GOVERNING AUTHORITIES TO BE A NON-REPORTING COMPANY TO BE TRADED ON THE PINKSHEETS, THEN HOW IN HELL'S HALLWAY CAN THEIR BE A DELAY IN REPORTING?????
You're making an incorrect assumption here. The SEC does not pre-approve a change in status from reporting to non-reporting. Per Rule 12g-4: "The issuer's duty to file any reports required under section 13(a) shall be suspended immediately upon filing a certification on Form 15..."

If a company meets reporting thresholds, it is required to file periodic SEC reports even when trading on the pinks/greys. If a stock is delisted from an exchange, Nasdaq, or OTCBB to the pinks/greys, the company is required to continue filing unless they submit a Form 15 certifying they fall below reporting thresholds. In CMKX' case, the 2003 Form 15-12G was filed under false pretenses which may be the reason the SEC is playing hardball w/ them.
