my TDA says 38.1 shares out...does this mean this is the float?


No, shares out refers to shares issued and outstanding. Both the company (through its attorney) and its transfer agent (TA) have disclosed that the current number of common shares issued and outstanding is 3.1 billion.

Call the TA if you want to personally verify the O/S. The telephone number is in the iBox. Share counts provided by the TA are much more reliable than those shown by brokerages. The TA has the most up to date information - even moreso than the company. However, SSPT is not allowing the TA to release the current float or number of restricted shares outstanding (which would allow calculation of the float).

If you want to know why your brokerage shows a substantially different count, you should call them to learn the source of the number of shares outstanding they publish as well as to ask why it differs so substantially from the number both the company its TA have disclosed.

The float is a minimum of 272 million (# as of 12/17/10) and as high as 522 million following the increase in O/S of 250 million between 12/17/10 and 12/20/2010.
