First ICM tried to say the invention was unpatentable. Then Greenshift got the patents.

ICM then said that Greenshift was guilty of unfair competition because they sent their customers letters warning
them against possible patent infringement. Greenshift was required by law to send those letters, and it was really just an ICM stall tactic.

Then ICM tried to say they had prior art for the Tricanter and they were counting on a patent. That's funny, I thought they said it was unpatentable. Anyway, the Flottweg Tricanter patent was denied, twice, because it belongs to Greenshift.

So their last hope is to claim that the invention was disclosed more than one year before the patent application date of August, 17, 2004. At least they're now admitting that Greenshift was the first to disclose the patent in late 2003. Anyway, a letter was dated but not disclosed, on July 31, 2003. The letter was then hand delievered on August 18, 2003, which is less than the one year window making the patent fully valid and 100% enforceable. ICM can't prove the letter was mailed in July, because it wasn't. Greenshift has the proof, in exhibit A, that the invention was disclosed on August, 18, 2003.

Here we have credit card statements, airline ticket purchases, hotel purchases, a car rental, and a sworn statement proving that the invention was disclosed to Agri-energy on August, 18, 2003.

Too Bad for ICM, they knew they'de lose this case all along but tried to drag it out and bash Greenshift into the ground on these financial forums.

All of this information was reviewed by the patent examiner, Deborah Carr, before the patents were issued.

ICM, Flottweg, and Westfalia, you lost this case and now you're gonna pay the price for patent infringement. Your strategy of throwing everything up and hoping something sticks has failed. It's transparent that you've broken the law. So why don't you give yourselves a chance to crawl out of the hole you put yourselves in, instead of digging that grave deeper?
