It is possible that, since Diac dropped his request to have the patent sold, the only issue that the fed court may have had an interest in has been settled. There was always a question (raised by T-Mob) that not all the real parties in interest (parties who had a stake in the patent) had been attached. If T-Mob feels comfortable about that issue then the settlement may go forward. I don't see them announcing a settlement contingent on the Calypso winning the state court case. That might be good for Calypso, but I don't see any benefit for T-Mob in doing it.

Without knowing what assurance regrading the patent T-Mob will want in the settlement ( they will defiantly want a guarantee that Calypso is the agent for all the owners of the patent, that the owners hold free and clear title to the patent, etc.).

I guess I just would not be surprised if we get a request for an extension of the stay. I would actually place in in the "more likely than not" category.

Lets hope I am wrong.
