Functional patent on generic lovenox?



MNTA is saying no such thing. What MNTA is saying that TEVA took the short cut of stealing MNTA's IP to create their amended ANDA. There is no issue whatsoever that MNTA holds the patents on generic lovenox. Just anyone who wants to produce a generic lovenox had best not steal MNTA's IP to do so. They can product their generic lovenox the old fashion way, or with new fangled processes that don't infringe MNTA's IP.

Practically speaking, does this mean that no one can meet the rigid standard that the FDA set out if they don't use MNTA IP? Maybe. But that is not MNTA's problem.
