I have never produced/directed a movie but MY GUESS is that it would be hard to sign a new actor for the role before you even know if the other actor is going to be out. I would guess that they have talked to actors about filling the role, but nothing would be signed until they know 100% for sure he cant be in it. Otherwise you would have two contracts for the same role (seems like a waste of money to me).

I know its not the same thing but look at the Lohan ordeal she was supposed to spend so long in jail and only served a fraction of the time. Im not saying that is going to happen with Snipes but you never know.
