The conflicting stories about the BUD and the SW permit are almost approaching comical now.

I have not heard anyone from the DEC say anything like that. Only place I hear that story is here on the board.

So, the official stance from JB as of a couple of days ago is, that no BUD or SW permit required. I'll make note of that.

I would love to know ,as I'm sure a whole slew of other investors as well, who it was from the DEC said any such thing.



I am sorry for responding to a question you posed to someone else, but I thought I might try to reconcile this conflict. The original poster stated that a BUD or solid waste (SW) permit should not be required. So far as I know there has not been any official word from the company as to whether or not a BUD or SW permit would be required. This suggests to me that there are ongoing discussions on this issue, and that no official decision has been reached.

The conflicting reports may be due to different opinions expressed by different DEC reps in different DEC regional offices. I have seen at least two different regional offices mentioned during the course of this debate, and at least four different contacts mentioned. If there have been inter-office conference calls in the last week between DEC reps on this issue (as has been reported on this board), then I would guess that there is ongoing debate within the DEC as to what, if anything, is required of JBI under the solid waste provisions of the DEC regulations. Until an official decision has been rendered by the Region 9 DEC office, we can't be sure what will ultimately be required.

To be clear, I am not questioning any poster's veracity. Rather, I think this conflict reflects a difference of opinion between DEC representatives, expressed in advance of any formal decision. I base this opinion in part on the last post I read on this issue, in which it was stated that Mark Hans was declining to take JBI-related calls because he did not have any answers on this issue. Until Mr. Hans (i.e., a Region 9 DEC solid waste contact) and the rest of the Region 9 DEC team reach their decision, there shouldn't be any official word on the issue. So far as I know, that has not happened yet.

If anyone has learned of the official word from Buffalo, and I missed it, then please let me know. Hopefully this matter will be put to rest soon.
