I agree based on my review of the website and conversations with the DEC, neither a BUD nor a SW permit is needed. But i have zero experience in this field so i find it extremely comforting that you have the same findings as i do since you are clearly somebody with vast knowledge, experience, and extremely savvy analytical skills above all of us here combined many times over.

I have handled dozens of permits in this sector. We have permits for waste, water, air, etc...

Based on my review of the regulations in NY, they do not require a BUD or a SW permit. I believe a BUD was filed as a formality.
