spitsong, a big issue in the Burst suit

was the fact that MSFT was allegedly negotiating for two years with Burst, giving them lots of access to the Burst technology. Though access isn't the same issue in a patent case as in a copyright case, it doesn't warm a court's heart to see what might be a showing of bad faith on Softee's part. That had to be a big issue in MS decision to settle. Whether Quicktime has borrowed or not, I dunno. But no one has claimed Apple did anything like that to build QT, at least that I read about the last time this case was in the news about a month ago.
