Diac has never wanted to be owner of the patent. That requires work. Work to pursue infringers and work to cut licensing deals. Things he has never shown an inclination for. He has always been about money. He could have had the patent after the verdict but in 2008 he choose to cut a deal with the company to do all the work (with the added bonus of sucking the company dry of any funds it had for current operations). He could have tried to keep it after the defaults but instead tried to auction it. He could have asked the court in the current state case to give it to him as per the security agreements but instead originally asked that it be auctioned. He has never shown any inclination to take possession of the patent - only to profit vicariously from it.
