If in fact a notice of claim was received, how can failure to notify the BOD be perceived as anything short of a purposeful ommission. Then you would have to ask has Cowsert gained any benefit especially given the fact his name is on almost every 'positive' press release since 9/9/10.

On the other hand, if notice of claim was never received, the whole thing could be thrown out?? (I'm not an attorney nor do I play one on television).
