I don't agree with your interpretation. Have you read the Special Exceptions, Second Amended Answer, affirmative defenses and counterclaims. Diac is not asking for the patent directly, but is asking for the money due on the notes. In lieu of that he asks that the patent be taken and sold, NOT for the patent to be turned over to him. It is an odd tactic if what you want is to take the patent for yourself.

If anything he is trying to force the deal with TMob in order to get some money out of the deal.
