Another quote from Gerber in that document:

"...even with a bond, granting the relief at all would be unduly prejudicial to equity security holders (the majority of whom are “retail” or “mom and pop” shareholders, who would legitimately be looking for their Plan entitlements), and that the bond would not sufficiently help them."

Pentair is appealing to the Disrict court. Hopefully they get denied there too, it's $20mil of value that should be coming to us which they want.
