Expert witness is pretty much as it says. You don't need a PE license to be or become an expert witness. You need experience in what you are speaking or testifying about. Hyopthetical case, I am an electrical engineer and have worked on construction projects installing the electrical systems for 30 years. Is my experience not valid if someone needs testimony in a case involving this type of work vs. someone who has a PE and has 5 years experience? The attorneys look to find the expert who has the qualification/experience for whatever they need the testimony for. There are a significant amount of people who have taken the PE test and have the certification but no experience and wouldn't last two seconds under cross. I have seen what some of these wonderkind are capable of producing to be installed. Better off having a first year apprentice design it.. but I digress
