Again, you have no idea if they are actually negotiating a deal or not with TM. My guess is not. My guess is that TM is stalling trying to run out the clock. I don't know why TM would ever do a deal knowing the patent ownership itself is in question. At the very least, they will wait until the state case is done, so don't look for anything until then.
