Mediation is to end on 25 Oct, that is monday. I haven't seen anything that says depositions were required to be done prior to mediation and 15 Oct was the date Discovery was supposed to end. That is probably the reason for the request for a pre-trial conference to sort out these issues with compliance, change the venue, get rid of the Daic attorneys and force compliance with the court. The docket listed 1 Nov as the date ADR is to be completed. I think it possible that a settlement agreement can occur anytime before or during a trial, most people are betting the Daic parties won't settle. I believe they are in a different game at this point and their easiest way out is a settlement agreement. Their risk is much greater going forward, the prior game is over, a new team is in place, the rules are different, the games goes 4 quarters not 2 unless the Daic parties forfeit the game. Calypso can not do anything but proceed on the path to trial.
