By my reading, the application and process tracks along the lines of Agilyx's given they emit similar pollutants. The pollutants are what makes this "minor project" fit the "not normal circumstances."
In New York DEC-terms this means a State Facility Permit and comment period at minimum. Then a determination if a hearing is necessary.
As a side note, the notion that the DEC is more connected to P2O because they are working with them now pre-application submission is also stretching truth to make it appear larger and more significant than it is. Applicants may request a pre-submission conference with DEC personnel in the normal course of following the process.
Some people are reading the e-mail from the DEC employee as tracking darn near 100% with what this board has been promulgating. I see it as proving the point of how far "what is" is being skewed to fit "what is desired"
