Thanks for the PMs-- let's be clear, their own report contained crtieria pollutants. Again same as Oregon facility:

Regulated air pollutants include the criteria pollutants, individual HAP's (as defined below), and any other contaminants being emitted from regulated processes and governed by applicable federal and/or state only requirements. To assist applicants, the first 8 lines of CAS #=s/contaminant names are prefilled and represent the following criteria pollutants: PM10 - particulate matter less than 10µm in diameter, Particulates - total particulates, SO2 - sulfur dioxide, NOx - oxides of nitrogen, CO - carbon monoxide, lead - elemental lead, VOC - total quantity of volatile organic compounds in all forms, and HAP - total quantity of any of the 189 hazardous air pollutants listed in section 112(b) of the Clean Air Act Amendments of 1990 being emitted.

State facility permits are issued to facilities that are not considered to be major (as defined in the department's regulations), but that meet the criteria of Subpart 201-5. These are generally large facilities with the following characteristics:

•Their actual emissions exceed 50 percent of the level that would make them major, but their potential to emit as defined in 6NYCRR Part 200 does not place them in the major category
•They require the use of permit conditions to limit emissions below thresholds that would make them subject to certain state or federal requirements
•They have been granted variances under the department's air regulations, or
•They are new facilities that are subject to New Source Performance Standards (NSPS) or that emit hazardous air pollutants.


Don't think you can get around this and if you can't, you get a public comment period and then review for hearing determination.
