With Black Elk, I believe they are a private company from what I saw that was stated within the ESPI PR and here on their website below:

Black Elk Energy is an independent oil and gas company headquartered in Houston, Texas. ...

That statement above is not a 100% indication of being a private company, but it's what led me to do some more snooping around their website of which it looks to be a private company in my opinion.
