This was not a suit about Spongetech the company but was an add on complaint accusing the NY Post of slander against Moskowitz personally. I suggest you read the lawsuit and if necessary, take it to a professional to explain it to you if you do not understand this yourself.

Moskowitz (the individual) is removing himself personally from the claims. Had he had a case and won, he personally would have received an award because he was claiming PERSONAL damages. Moskowtz [the crook] is removing himself from any financial gains associated with this lawsuit.
