Inequitable conduct is alive and well after all—at least with respect to Taxotere. The Court’s finding that Sanofi engaged in inequitable conduct in the Taxotere case is presented on pages 57-65 of http://www.pubpat.org/assets/files/taxotere/Taxotere_Decision_September_27_2010.pdf .

Sanofi failed to disclose to the USPTO that the essence of Sanofi’s Taxotere formulation patents—using polysorbate 80 as a surfactant in place of cremophor—was described in prior art and had been used by Sandoz in two of its chemotherapy drugs (Etoposide and Teniposide).
