Management finally has proof that they are suffering significant on going damage from the web site they have two responsibilites to stop the damage and to seek compensation.

imho, the company needs to make that the threshold for preponderance, or is it clear and convincing evidence? imho this puts the company over the top in both categories

they cannot afford to let this go
