Civil suits cost money. Who will pay? Criminal charges don't automatically remove DB from being CEO. I've seen a company (Fog Cutter Capital in Portland) where the CEO ran the company from jail after felony conviction on company debt -- and the company paid his legal bills (he controlled the votes).
