If the maintenance fees for the '396 patent have not been paid, is it considered expired and unenforceable?

According to the patent bibliographic info you posted, the company should have paid maintenance fees by 02/23/2010 but could still renew with a late payment plus surcharge by 08/24/2010 (total = $2,120.00):
