Here's OSTK's FTD data from that web site for 2010.
I noticed the larger number of fails between May 27 and June 8, 2010. Mr. Byrne happened to file a 13D on May 25th, so was there some adjustment in his holdings that took a few days to settle?
Looks like that would be a reasonable explanation.
He probably holds all his shares in a lock box some place, and it takes a few days for his shares to get from cert form to electronic form i.e. street name.
