Very true but there would still be some sort of settlement. Here in Chicago, this past year, there was a retail store that was still printing their customer receipts with the customer's full credit card on them. There, of course, was a class action brought against them to fix this and to point this out. No one had any damages or financial loss due to this oversight.

Here is how it played out:
1) Lawyer received almost $2,000,000
2) Store had to pay lawyers and give everyone 10% off next purchase coupons
3) The litigants received said coupons.
