The Supreme Court remanded the Mayo vs. Prometheus Labs case to the Federal Circuit for reconsideration in light of Bilski. So, we're going to see how this one will play out in the post-Bilski era. I believe (and I assume Peter will concur) that Prometheus patents will hold because the Supreme Court ruled that the "machine or transformation" test is not the only test for patent eligibility.
