Just got off the phone with NASDAQ...
I called the main number of NASDAQ: 212-401-8700. I asked to be transfered to the "Listing Qualifications" Department. I spoke to an analyst named Mike. I asked him this question:
If an OTCBB company wanted to uplist to a NASDAQ Capital Market Company, but in the meantime the OTCBB company became late with their 10-K and now had an "E" appended to their symbol, could they still go ahead with the uplisting; would they have to wait one year to quality, or could they continue with their uplisting plans as soon as they became current with their filing.
Mike said they could not uplist until they became current with their filing. He said there is no such thing as having to wait one year to quality. As soon as the "E" was removed, they could continue with their uplisting merger plans.
