The Intergraph and Intel dispute has a peculiar twist. Intel already has a License under the patents asserted by Intergraph in the Texas law suit, currently sitting before the Judge and waiting for a decision after a trial. The only question is how much Intel will pay.

If Intel ultimately prevails in the Texas lawsuit then they pay nothing. If Intergraph wins at trial and Intel does not appeal, Intel pays $150 million. If Intel appeals and loses, it pays Intergraph $100 million more for a total of $250 million.

The payment terms were disclosed in the public announcment of the settlement.
