berg, Reg SHO;I spoke with 3 people at the NASDAQ and NASD offices. SCMI was on the list in error the 1st 4 days, as were most,if not all pink sheet companies. Per the SEC and this new ruling, the threshold calculations are based on undelivered shares compared to the reported and filed TSO (Total Shares Outstanding).
In the NASDAQ's initial lists an operator inserted "0" for what the company reported, this based upon any undelivered shares, it automatically put them on this list.
In order to be considered for this list, SunnComm must file an 8-k, 10-q or 10-k.
Until then, SunnComm nor any other pink will benefit from this ruling, and as the NASDAQ said, the companies are failing to inform investors how many shares they are issuing, thus cannot expect regulatory assistance in controlling what % of shares are not delivered.
The 3 numbers for NASDAQ / NASD I called were 800-846-0477 and 202-728-8071 and 866-776-0800
