It is only false and misleading if UMG was already using MM5 when the pr went out. There is expection that they are already using MM5, if UMG starts using MM5 today and was not using it Wednesday and SCMI did not know it would then it would not be false and misleading. This would be a very unsual false and misleading pr because the pr would be leading someone to believe that they may use the product in the future when they are in fact already using the product and paying royalties. I have never seen this before.
