Was EGMI operating legitimately?...

I suppose it's a matter of degree. I don't believe we will know the degree until amended 10-K's and audited financial statements are filed. The best information at this time is probably the company's 8-K filing dated May 18, 2010:

The level of current operations, if any, are in question. The website is down and I haven't seen any reports of operating activity, other than dealing with these historical issues, since the Poken demos in February 2010.
