This is the likely scenario. I called the SEC the day ACLH was suspended, and left a message. They actually called me back a few hours later. They really didn't answer any of my questions except to say ACLH would resume trading at 12:01 AM eastern on June 9th. However, they had plenty of questions for me. Such as: Why did I buy the stock? What information did I use in the decision to purchase? Where did the information come from? You get the picture? They went after this company solely on the PR's. My concern to them was that when trading resumes, people would flee like rats leaving a sinking ship, and why wouldn't it resume during market hours. The broker I use doesn't allow access to these markets during after or pre-market hours. So anyone having access will determine the opening price. There may be a massive selloff, but who's going to buy? A point of interest, on the website for ACLH they still maintain the use of their products for cleanup of the gulf oil spill, but no mentions of BP interest.
