I have read good arguments both ways (Pinks vs. Greys). I personally don't know. I would think that there are alot of things that would go into the deciding factor. I think it will depend on what the SEC thinks of what ACLH supposedly submitted to them.
I also think that ACLH seemly did overstate or imply a relationship with BP. They have a relationship with a BP contractor. Not really the same thing. We will see what the SEC thinks about it.

I just hope the product does what they say, and can in some way help clean this mess up, its only going to get worse.
