scion's post addressed my question as clearly as it could be addressed.
The answer and the new SEC policy, unfortunately complicates the self-incrimination issue. I doubt that they really need the testimony of the defendants in either case. But if they do, the impact of trying the civil complaint first would be that the defendants could refuse to testify based on the fact that their testimony would jeopardize them in the criminal case.
It's messy stuff.
