It is a promo trick. Note the way the lawsuit was leaked to the message boards before it was ever on the docket. They may never serve the defendants. If they do serve the suit, one of them needs to counter-sue so they can hold SPNG in court. Otherwise, they will likely drop the case before it ever gets to discovery. This is a promo trick of penny scams going way back to the late 90s.
