If the government is putting up fences and gates it will be on public lands not private. However, there could be some directives from MSHA, the local Sheriff's office, or the BLM and/or the Forest Service to protect the public from open mines and shafts. Some mines are grated to human access but open to bats, since mines can be good habitat for those tiny little critters.

Or maybe the mines are closed due to radon gas or they have been forclosed and are now up for sale. Your guess is as good as any bodies.
