In all the years I spent in Wall Street and in the NASD Trading House---it never made one "iota" of difference to us whether there were sells above the mkt or not----

If we had to short to maintain an orderly mkt, we did....It is the FTDs that are a concern---and the naked shorting by an MM to maintain mkt liquidity is expected, accepted and not frowned upon---

The FTDs by the selling MM is definitely frowned upon----but in a "pinkie" and in Pinkie Landalmost impossible to regulate---

The reputible firms try to stick together and stay clear of "KNOWN" scam houses---

If your shares are with your broker and in a margin acct,, they will be used by the MM-----You can move them to a cash acct and request that they not be made available for shrt sells---or take delivery.
