That's assuming that you can track those "naked shorts" and that majority of air shares were actually shorted. What I saw from transcripts posted here some time ago (conversations of Dynkovsky & Co, that directly mentioned AURC and Parkin) - big part of unregistered shares were supplied by Parkin, who represented Aurus management at that time. So, from legal perspective Aurus itself was a distributor of "fake" (unregistered) shares. Of course, you can blame everything on old management, but unless you resolve this legally (sue them), it's Aurus, not Parkin, who produced shares and would have to pay dividend.
