What you own or have on the block or in your house has no bearing on whether the MM can short the stock----

He is charged to maintain an orderly mkt---and when buys outstrip sells he will short ---as in sell you the shares-- and later he will balance his books---either at the end of trading for that day or sometime in the next few trading days---

If you own a marginable stock in your account and a retail customer wants to short that stock,, your broker can borrow your shares and deliver them to the buying broker as long as they are in Street Name----

You can also direct your broker in writing that you do not want your shares made available for "shorting"---you can also take delivery to prevent other retail customers from using your shares to "sell short" stocks they do not own--

But "penny stocks" are not generally shortable by retail customers--legally----

The MMs can short any stock when is acting in his capacity of Market Maker----
