the EC does not have to protect anything...

their main job is to make sure everything is fair and just, based on the BK rules. Which means that if share reorganization is made, it will most likely affect the commons.

Preferreds would be paid off even at a discount, along with the unpaid dividends that have accrued more than 3 qtrs...

commons do not have that privilege.
